NASH CREATIVE DIGITAL LLC
Privacy Policy
Effective date: October 7, 2026 · Last updated: October 7, 2026
This policy explains how NashCD handles inquiries, payment records, website materials, and personal information used to provide our services.
1. Who we are and what this policy covers
Nash Creative Digital LLC ("NashCD," "we," or "us") provides website design, hosting, domain management, and related services. This policy describes how we handle personal information through nashcd.com, inquiries, subscriptions, and our services. Contact us at darren@nashcd.com with privacy questions.
For a website or association portal we operate for a client, the client determines what information is collected or published and who may access it. We handle that information on the client’s instructions under our service agreement. That client’s privacy notices also apply; this policy does not replace them.
2. Information we collect
When you contact us, we receive the name, email address, optional phone number and business name, message, and any materials you provide. Service records may include correspondence, approvals, website content, domain registration details, and account-access information needed to perform the agreed work.
When you subscribe or pay, Stripe collects payment and checkout information. We receive records needed to administer your subscription, such as contact and billing details, plan, transaction status, invoices, and limited payment-method details. Full card numbers and card security codes are entered with Stripe rather than through our website’s contact form.
Our hosting and service providers may process technical information such as IP addresses, browser and device information, requested pages, timestamps, and security logs. Please do not submit passwords, full payment-card details, or sensitive personal information through the public inquiry form.
3. How we use information
We use information to respond to inquiries, prepare proposals, provide and administer services, manage domains and subscriptions, process billing and cancellations, communicate about your account, maintain security, prevent misuse, and meet legal obligations. Where applicable law requires a lawful basis, processing may be necessary to perform a contract or requested precontract steps, support legitimate business and security interests, comply with law, or act on consent.
Providing contact details for an inquiry is not consent to unrelated promotional messages. You can ask us to stop promotional communications; necessary billing, security, and service communications may continue. We do not use the current NashCD website for targeted advertising or operate a business selling personal information.
4. Service providers and disclosures
We disclose information as reasonably necessary to providers supporting the services, including the following:
- Namecheap and hosting/domain providers: website hosting, technical logs, domain registration, and portal storage. Domain registrars may need registrant details and may disclose them as required by registration rules. Namecheap privacy policy.
- FormSubmit and email providers: our inquiry form sends submitted information through FormSubmit to our business email. Email correspondence is also handled by the relevant email providers. FormSubmit privacy notice.
- Stripe: checkout, recurring payments, invoices, fraud prevention, and payment records. Stripe also processes information for its own purposes as described in its privacy policy.
- AI service providers: processing described in the next section, subject to the limits in our agreement.
Providers may have their own privacy practices for information they process for their own purposes. We may also disclose information when legally required, to protect rights or security, or to professional advisers subject to appropriate confidentiality. If our business is transferred, relevant records may be transferred subject to applicable law and appropriate safeguards.
5. AI-assisted services and private portal documents
As described in our Terms of Service, we may use AI-assisted tools, including OpenAI Codex, to build code and prepare or incorporate materials supplied for a website, such as public-facing photographs, logos, text, and documents. Processing may involve sending those materials to the AI provider. We review AI-assisted work before publication.
Association documents uploaded directly to a client portal are stored through our hosting provider and are not automatically sent to Codex. Nonpublic portal documents and other nonpublic or restricted client materials require the client’s specific prior written authorization before AI processing. Hosting administration access does not expand that authorization. We limit access and take reasonable precautions to avoid including private documents, credentials, and unrelated client information in AI inputs or outputs.
AI-provider handling depends on the service and account settings used. We do not promise that all processing occurs locally or that providers retain no information. Client authorization and our confidentiality duties remain governed by the Terms of Service.
6. Cookies and similar technologies
The current NashCD homepage does not include advertising pixels or third-party analytics scripts. Hosting infrastructure and third-party services such as Stripe and FormSubmit may use cookies or similar technologies for functionality, payment processing, fraud prevention, or security. Their notices explain their practices.
You can control cookies through your browser settings. Blocking them may affect third-party forms or checkout. We will update this notice if we add analytics or advertising tools that materially change our practices.
7. Retention and security
We retain inquiry and service information for as long as reasonably necessary for the purposes described here, including ongoing services, billing, required records, dispute resolution, and security. Retention depends on the type of information, our legal obligations, and provider practices.
Client website and portal handoff materials follow the retention provisions in Section 9 of our Terms of Service: available materials are preserved through the 30-day handoff-request window after service ends and, for a timely request, through delivery and at least ten business days afterward. Later deletion is subject to legal requirements and disputes. Billing and acceptance records may be retained separately.
We use reasonable safeguards and limit access to information needed for the work. No website, email, or storage system is completely secure. Do not rely on a client portal as the only archive of official records.
8. Your choices and privacy requests
Email darren@nashcd.com to request access to, correction of, or deletion of personal information we hold about you, or to ask about other privacy rights. Depending on applicable law, you may also have rights to portability, restriction, objection, withdrawal of consent, or a complaint to a privacy regulator. Rights and exceptions depend on your location and our legal obligations.
We may need to verify your identity and authority before acting. We will respond as required by applicable law and explain any relevant limitation, such as required billing retention. Withdrawing consent does not undo processing already lawfully performed and may affect a service that depends on that processing.
For information controlled by a client business or association, contact that client first. We will assist with requests as appropriate under its instructions and applicable law.
9. Children, other websites, and international processing
Our business services are not directed to children under 13. If you believe a child under 13 provided personal information directly to us, contact us so we can investigate and take appropriate action.
Links to other websites and providers lead to services with their own privacy notices. Information may be processed in the United States or other countries where our providers operate. Where applicable, required safeguards for international processing apply.
10. Policy updates and contact
We may update this policy as our services or practices change. The date above identifies the current version. We will provide additional notice or obtain consent where required by applicable law. A change to this page does not override the notice and approval requirements in our service agreement.
